Elder Abuse and Neglect: Is Your Elderly Loved One at Risk?

Nursing Home Abuse

According to a recent CDC report on long-term care providers, over 67,000 nursing and other elder care facilities in the U.S. provided residential services to over 9 million aging Americans in 2013-2014. Many of these facilities provide high quality care for their aging residents.

However, some of these 9 million residents encountered neglect or abuse. In fact, according to the ABC news site, a study showed that 30% of nursing home facilities were cited for elderly abuse over a 2-year period. Despite this seemingly large percentage of cases of abuse, elder abuse is considerably underreported.

A congressional report indicated that over a 2-year period, nearly 10% of nursing homes had violations that caused serious injury to residents . And reports indicate that the number of cases against elderly residents is increasing. Perhaps even more shocking, the Atlanta Long-Term Care Ombudsman study revealed that 95% of respondents had witnessed another resident being abused or neglected in a nursing home facility.

Obviously, any type of abuse is intolerable. But elder abuse is particularly alarming because many of the victims are either insufficiently aware, unable, or too scared to communicate the abuse or neglect. Consequently, the abuse statistics we see are significantly underreported.

There are several types of abuse that have been inflicted on seniors in nursing homes and other facilities including physical, sexual, emotional, neglect, and financial exploitation.

Physical Abuse – causing physical pain or injury from hitting, bruising, or restraining

Sexual Abuse – imposed non-consensual sexual contact

Emotional Abuse – inflicting mental pain, anguish, or distress through verbal or nonverbal acts including intimidation and humiliation.

Neglect – failing to protect or failing to provide food, shelter, or proper care

Financial Exploitation – illegally misusing or concealing property or assets including misuse of credit/debit cards, withdrawing from accounts and using the money for self benefit, and unauthorized money transfers.

Nursing Home Neglect and Abuse: What You Should Know to Protect Loved Ones

Share

So many of us trust nursing homes and assisted living facilities to care for our beloved and most vulnerable elderly family members and friends.   Since we are frequently unable to care for the elderly in our home, we rely on these facilities to provide proper nursing care, medical services, and safe, healthy environments for the elderly.  These licensed facilities are required to meet certain requirements and provide the quality of care to which each resident is entitled.

As much as these facilities tout the excellent care they offer their residents, unfortunately, nursing homes and other skilled nursing facilities don’t always live up to these commitments.  Failure to follow minimal safety standards can result in bed sores, falls, unaddressed infections, overmedication, dehydration, injuries, and untreated medical conditions.

Be aware of these potential signs of abuse and neglect:

  • Bed sores, unaddressed infections
  • Falls, broken bones, and bruises
  • Fear, crying, or withdrawal from relationships
  • Poor hygiene
  • Malnutrition and weight loss
  • Overmedication

Nursing home abuse and neglect can affect patients physically, emotionally, and even financially.  Abuse typically includes physical or financial abuse, emotional abuse, sexual abuse, abandonment, isolation, abduction, and other behaviors causing pain or mental suffering.  Neglect typically includes failure to protect patients from health or safety hazards, failure to prevent dehydration or malnutrition, and failure to provide appropriate medical care and assist with personal hygiene.

When patients are harmed because licensed facilities fail to meet minimal standards, they should be held accountable.  Goldman & Daszkal, P.A. advocates on behalf of patients who have been abused or neglected.   Our attorneys provide experienced, reputable legal guidance for elderly abuse and neglect as well as for violations of residents’ rights.

While we cannot change the incidents that happened earlier , we can thoroughly investigate the facts and aggressively pursue cases of abuse and neglect to ensure that these facilities are liable for their actions and that the victims recover proper compensation for their injuries.
