Over the last 14 years here at Goldman & Daszkal, I’ve taken several calls from potential clients asking about pursuing an injury claim, and several of those calls have actually been from people who were at fault for the accident wanting to know if they can receive compensation for their injuries.
The answer for that is yes, but with a caveat.
You can receive compensation if you’re at fault, and that’s where the Florida No Fault Law comes into effect, or the personal injury protection. Your insurance company will provide benefits to you for up to $2,500 or $10,000 depending upon your injuries and they’ll pay 80% of your medical bills either directly to the doctor or reimburse you for expenses that you’ve incurred. Additionally, you can also receive compensation for lost wages at 60% up to those same limits.
So, yes, you can receive compensation even if you’re at fault for the accident, but it’s limited to those amounts and those coverages. If you have further questions regarding that, please give us a call. I’m happy to go through that with you and explain it in more detail.
